Ahoy! That is What Cruise Ship Passengers Expect—Not a Sexual Assault

Ahoy! That is what cruise ship passengers expect—not a sexual assault when leaving the ports of Los Angeles and heading out to the open waters. What they do not expect is that they could return to the ports of Los Angeles as a sexual assault victim.

The facts about cruises are:

  • More sexual assaults happen than most passengers realize, with enough that there has been legislation enacted to protect the rights of the cruise ship sexual assault victim.
  • Cruise lines and travel agents do not publish this danger for potential passengers to see, they do not want them to know that sexual assaults are a danger onboard the vessel.
  • Cruise ship passengers for the most part do not realize that the ship they are on does not have to follow the laws of the United States, because they are registered and carry a flag from another country. This means they follow the laws of the country in which they are registered.
  • Cruise lines are responsible to take care in hiring crew members and this includes background checks. There has been crew members involved in sexual assaults.
  • Cruise ships leaving out of the ports of Los Angeles and other Southern California ports, once they have set sail the laws that apply for sexual assaults and other crimes are different than those that occur on land.

The passenger who becomes a victim of a sexual assault while on a cruise according to the new legislation, the cruise line is required to offer sexual assault forensic examinations and medication to prevent sexually transmitted diseases. This should be taken advantage of by the cruise ship passenger that is now a victim of a sexual assault, because it can be important later when holding the criminal accountable and the cruise line.

The cruise line has an obligation to provide a safe environment for their passengers, when it is not safe enough and a sexual assault has occurred they can be held accountable.
The passenger that has become a victim will need the assistance of a cruise ship sexual assault attorney to hold the cruise line accountable for not providing a safe environment that lead to the attack.

It is important to have an experienced sexual assault attorney, not only a car accident attorney, because the laws that will apply are different than those of Los Angeles, California and other states, due to treaties, your passage contract, and international laws, and the cruise line will have attorneys protecting them.  You should have someone representing your interests, such as Ehline Law Firm PC at: (951) 777-2474 0r by mail at 41593 Winchester Rd, Ste 200, Temecula, CA 92590.  Call to learn more about your legal rights as a cruise passenger victim.

Bicycle Crashes Take Lives

Bicycle crashes take lives in many cases, in others the bicyclist is severely injured, since they have very little protection. The most protection that a bicycle rider has when they are involved in a collision with a motor vehicle is their helmet, possibly knee and elbow pads. This is not a lot of protection compared to the driver, who will have the metal encasement of the vehicle, airbags and a seatbelt, which in most cases will not even be needed.

The roads of Newport Beach can be deadly for the bicycle rider, even when they obey the traffic rules for bicyclists and watch the traffic around them. If the driver of a vehicle is not watching their surroundings it can be a fatal collision. The most common reason for bicyclists being killed is traumatic head injuries and internal injuries, since they will either hit the pavement or be thrown onto the vehicle.

The vehicle that hits a bicycle rider can be a passenger car that belongs in the neighborhood, a delivery truck, garbage truck or someone driving through the area as any qualified car accident attorney would know. No matter what type of vehicle it is the results can still be the same, because bicycle crashes take lives. The bicycle rider that is injured can expect to suffer possible head and neck injuries, spinal cord and internal injuries and they can have cuts, scrapes and gashes. The roadway is not soft hitting and even when the collision occurs at a slow speed the rider still is going to be injured.

Bicycle crashes take lives, even when they occur in Newport Beach neighborhoods and when it is caused by a negligent driver the family can hold them accountable for their loved ones death. The Newport Beach bicycle accident attorney at: 620 Newport Center Dr, Suite 1100, Newport Beach - (949) 891-0278, is able to give the wrongful death victim that was involved in the bicycle crash a voice, hold the negligent party responsible and win compensation for the family that suffered the loss of a loved one.

The compensation that is won from the negligent driver can help to pay funeral costs, medical bills and other financial obligations. The experienced Newport Beach bicycle accident lawyer will be able to fight for the financial loss the adult would have provided for the family.

Why Cruise Ship Claims Are Not Simple

Why cruise ship claims are not simple is due to several reasons and there are only certain types of attorneys that are able to deal with the complex issues of this type of legal case. Cruise ship claims can be caused by an injury aboard the ship, an assault, a sexual assault or rape, but all of them have special laws that pertain to them making it difficult for the victim to understand all of the limitations for filing claims, if there is more than one negligent party and other issues.

Passengers leaving from Los Angeles on what they believe will be a vacation luxury cruise ship, only to be injured or sexually assaulted are often at a loss of what they should due. One of the problems in this type of legal claim that involves a cruise ship passenger is the fact that a cruise ship carries the flag from a different country. This means that the ship is registered in another country and follows their laws and it takes the experience of a cruise ship attorney to know the laws that apply for American citizen that is an injury victim.

Then there is the decision of negligence was a member of the crew negligent and the cruise line or is just the cruise line negligent. These are decisions that might be difficult or an injured victim or personal injury attorney to determine, but the experienced cruise ship attorney in Los Angeles and Santa Monica proper, understands the complexities and is able to determine which party should be held accountable. The next issue in why cruise ship claims are not simple, is due to their limits time the injured victim has file a legal claim, which the victim will not have any idea of the length of time may have. The cruise ship attorney will know time limit and know the necessary paperwork that will need to be filed to hold the negligent parties responsible.

There are other issues why cruise ship claims are not simple, like possible expert testimony that could be necessary to prove the cruise line is at fault in order to win compensation, there can be maritime laws that apply and the cruise line will have attorneys protecting them against legal claims of negligence. The Los Angeles cruise ship attorney such as Michael Ehline of the Ehline Law Firm PC at 201 Wilshire Blvd., Second Floor, Santa Monica 90401, 310.376.8488, is the Santa Monica personal injury attorney who can aggressively handle these problems and recover you compensation.

San Bernardino Train Crash Statute of Limitations

When someone is in a accident that’s catastrophic it might cause death and possibly lots of injuries to happen. Recently there was an accident that happened and all of the families had a lot of medical bills to take care of, funerals, burials plus not to mention grieving because of loved ones dying in the accident. Sometimes a statue of limitations is limited which might hurt the claim that might be against Metrolink. You won’t just need a San Bernardino auto accident attorney. You need to hire a lawyer who understands transportation laws.

The Southern California Regional Rail Authority operates Metrolink, which is also part of the government agency. Commuters plus passengers come from San Bernardino, Riverside, Orange County, Antelope Valley, Ventura Country and in the Los Angeles Area to ride the Metrolink. It’s a regional rail system and is known in California.

People should know that because Metrolink is operated by the Southern California Regional Rail Authority there are procedures that take place that might be special compared to other cases when a claim is filed. These procedures might have to take place before the lawsuit can begin. This goes for both a death that was wrongful and for personal injuries. After the claim is done then if it gets denied, a private party can file the lawsuit and has every right to do that.

There is a time limit on how long a person has to sue them. This falls under what is known as the statute of limitations and then the circumstances that happen could modify the claim that is being filed. A period that is specified is usually known ahead of time. When a personal injury claimant is not made and if the families from the deceased don’t file a lawsuit in that time period then they cannot get a lawsuit.

Victims of these kind of accidents should talk with a lawyer as soon as possible. It can be a very confusing and hard time but the lawyer can help with being able to sort things out and will know exactly what paperwork should be done. Seeking an experienced San Bernardino lawyer will help to ensure that things get handled in time before time runs out and victims of the family risk losing money that they need to pay off their bills and much more. Accidents can cause families to go bankrupt and cost them hundreds of dollars when they aren’t compensated. Church Bus That Crashed Injured Dozens and One Fatality—Had No Seatbelts Says Bus Accident Attorney

For Immediate Release

February 21, 2011—The fatal church bus that was involved in a bus collision Monday in the San Bernardino mountains was responsible for the injuries of two dozen people and the death of one person. According to California Highway Patrol Officer Mario Lopez stated that there were no seatbelts on the bus.

The bus was returning to the Light of Love Mission Church in Pasadena from a weekend retreat and filled with middle and high school students, when it collided with another vehicle on Highway 189.

The collision caused the bus to slide down an embankment approximately 20 feet near Twin Peaks. According to Cal Fire spokesman Bill Peters there were numerous broken bones, scrapes and bruises. Ten people were transported to Loma Linda Medical Center and Arrowhead Regional Medical Center in serious condition. Other accident victims were transported with mild to moderate injuries and two people were airlifted to the hospital in critical condition.

The church bus struck a 50 foot cedar, crumpling the front of the bus and killing driver Won Chae age 61. Chae had been a tour bus driver and volunteered to transport the teenagers.
Seatbelts are not mandatory on many buses in the state of California, but many of the injuries, including the broken bones might not have occurred if the teens onboard the bus had been wearing seatbelts at time of the collision and while sliding down the embankment.

The San Bernardino Church bus accident attorneys at Ehline Law represent injured bus accident victims and believe that serious injury might be avoided if seatbelts were installed in buses.

This has been a press release from our firm located at 633 W 5th St #2890, Los Angeles, CA 90071. 213.596.9642.

Pedestrian Accident Compensation

Pedestrian accident compensation—what it can mean to the injured victim is a way to help them heal as much as possible, while holding the driver and their insurance company responsible. The amount of pedestrian accidents yearly leaves thousands of victims seriously injured and hundreds of pedestrians that sustain fatal injuries.

These injuries are usually major injuries that can include traumatic brain and spinal cord injuries, broken bones, and other injuries. The seriousness of these injuries in many cases means a lifelong injury that can need constant care and medical attention. This is a reason why compensation is important and the best possible way to obtain the compensation needed for medical care now and in the future will be with the representation of an experienced pedestrian accident attorney.

Pedestrian accidents happen out of the negligence of the driver in many cases, but in some cases they are a true accident. When the pedestrian accident is through negligence of a driver they can be held responsible for the injuries they have caused the victim.

Pedestrian accident compensation—what it can mean to the injured victim is important for the estimated thousands of pedestrians that are injured each year and the family of the pedestrians that sustain fatal injuries. The pedestrian accident can happen in any city or town and as a resident of a beach city like Sunset Beach, Venice Beach, Marina del Rey, or Long Beach, just by crossing the street.  It can can be dangerous and the injuries that are sustained can be severe. Some types of injuries can have long lasting effects on the victim, which can mean ongoing medical care and even home care for life.

The Santa Monica pedestrian injury attorney will fight for compensation, not only for the current injuries, but also the injuries that are going to require ongoing care and home nursing care. This is important, because not every attorney will understand that ongoing care will be needed or the other parts of the injured victim’s life that will be affected.

After a pedestrian accident the victim should use their energy to heal, not to worry about getting fair compensation, that is the job of the Sunset Beach, or Santa Monica pedestrian attorney to protect their rights against the insurance company and to hold the driver accountable for their actions that caused the accident.
